Terms of Service

01 Overview # link

dinked.in is a pickleball tournament management, scoring, and community platform. We provide tools for organizing tournaments, tracking scores in real time, managing clubs, and connecting players.

02 Eligibility # link

You must be at least 13 years old to use the Service. By creating an account, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

03 Accounts # link

• You may sign up and sign in with a one-time code sent to your email or phone, with an email and password, or with Google or Facebook.
• If you give us your phone number, you agree to receive sign-in codes by text message. Message and data rates may apply.
• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate, current, and complete information during registration.
• You are responsible for all activity that occurs under your account.
• Notify us immediately if you suspect unauthorized access to your account.

04 Payments, Fees & Refunds # link

All payments are processed through Stripe. We do not store your payment card details.

Subscriptions

• A Premium subscription renews automatically each billing cycle at the price shown at checkout until you cancel.
• You can cancel at any time online, using the manage-subscription link in the receipt Stripe emails you, or by contacting support@dinked.in. Cancellation takes effect at the end of the current billing period.
• We will give active subscribers at least 30 days' notice of a price change.

Event entry fees

• Organizers can charge an entry fee for their events. The fee is paid through Stripe to the organizer's club, less a platform fee kept by dinked.in.
• The organizer, not dinked.in, runs the event and sets any other refund rules for it.
• If you leave an event, or the organizer removes you, your entry fee is refunded automatically.

Tips

• Tips are voluntary contributions to support dinked.in. They do not buy any product, feature or service, and they are non-refundable.
• A monthly tip repeats each month until you cancel it, which you can do at any time with the link in the receipt Stripe emails you.

Merchandise

• Merchandise is printed and shipped by our fulfilment partner, Printful, to addresses in the United States and Canada.
• If an order arrives damaged or incorrect, contact us at support@dinked.in.

Other refunds are handled on a case-by-case basis. Contact us at support@dinked.in.

05 Acceptable Use # link

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Harass, abuse, or threaten other users.
• Submit false scores, manipulate rankings, or engage in any form of cheating.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Use automated scripts, bots, or scrapers to access or collect data from the Service.
• Impersonate another person or misrepresent your affiliation with any entity.
• Upload or transmit viruses, malware, or any harmful code.

06 User Content # link

You retain ownership of content you submit (display names, profile information, tournament data, scores, club descriptions). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating the Service.

We may remove any content that violates these Terms or that we deem inappropriate, at our sole discretion.

07 Clubs & Tournaments # link

• Club administrators are responsible for managing their club members and content.
• Tournament organizers are responsible for the accuracy of tournament information, formats, and results.
• We are not responsible for disputes between players, clubs, or tournament organizers.
• We reserve the right to remove clubs or tournaments that violate these Terms.

08 Playing at Your Own Risk # link

Pickleball is a physical activity with an inherent risk of injury, including injuries caused by other players, equipment or venues. Games and events on dinked.in are organized and run by their hosts and players, not by dinked.in, and we do not control or inspect venues. You take part at your own risk, and you are responsible for deciding whether you are fit to play.

To the maximum extent permitted by law, you release dinked.in from claims arising from your participation in games or events, including claims about venues, equipment, or other participants. An event's organizer may ask you to accept its own rules or waiver as well.

09 Real-Time Scoring # link

The Service provides real-time score tracking for convenience. While we strive for accuracy, we do not guarantee that scores displayed are error-free. Official results should be confirmed with the tournament organizer or match participants.

10 Intellectual Property # link

The Service, including its design, features, code, and branding, is owned by dinked.in and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

11 Copyright Complaints # link

If you believe content on the Service infringes your copyright, email support@dinked.in with a description of the work, where the content appears on the Service, your contact information, and a statement that you have a good-faith belief the use is not authorized. We will review the notice and remove infringing content.

12 Privacy # link

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

13 Third-Party Services # link

The Service integrates with third-party services, including Google and Facebook (sign-in), Google Maps (location search), Stripe (payments), Twilio (text-message codes), Printful (merchandise) and DUPR (ratings). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

If you link your DUPR account, you authorize us to submit your match results to DUPR and to retrieve your DUPR ratings on your behalf.

16 Indemnification # link

You agree to indemnify and hold harmless dinked.in and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

17 Account Suspension & Termination # link

• We may suspend or terminate your account at any time for violations of these Terms.
• You may delete your account at any time through your account settings.
• Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

18 Changes to These Terms # link

We may update these Terms from time to time. We will post the updated Terms on the Service and update the effective date above, and we will email registered users about material changes. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

19 Governing Law # link

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California.

20 General # link

• Entire agreement: These Terms and our Privacy Policy are the entire agreement between you and dinked.in about the Service.
• Severability: If any part of these Terms is found unenforceable, the rest remains in effect.
• No waiver: Our not enforcing a provision is not a waiver of our right to do so later.
• Assignment: You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition, or sale of assets.
• Survival: Sections that by their nature should survive termination, including payments, user content licenses, disclaimers, limitation of liability, indemnification and governing law, survive it.
• Events beyond our control: We are not responsible for delays or failures caused by events beyond our reasonable control.
